7 Important Questions to Ask Your Prospective Divorce Attorney

Questions to ask your divorce lawyer

Divorce in the United States is becoming a common occurrence. The divorce rate for a first marriage is 41%, 60% for a second, and 73% for a third marriage. If you are going through a divorce it is imperative to consult divorce lawyers to offer advice for the entire divorce process. However, it is important to realize that you do not have to hire the first lawyer you meet. Here are seven questions to ask a prospective divorce attorney.

1. What is your specialty? Do you specialize in divorces, or is it just a part of your practice? How long have you been practicing law, and do you feel comfortable that you will be able to achieve the outcome I am looking for with my case? Do you have experience with cases like mine?

2.What is your strategy for my case? What is the best way to achieve my goals?

The idea behind this question is to be able to get a road map of the path the lawyer will take during the divorce process. Each attorney has their own specific way of dealing with cases, and it is important you understand theirs thoroughly.

3.Please describe your fee structure.

You will want to know if your attorney will bill you for each hour spent on the case, including time spent answering questions, or if it is a fixed rate. The attorney may also charge you for the time you spend with paralegals and secretaries filling out divorce forms. If you cannot afford the service charge take time to discuss a payment plan.

4.What should I be doing to protect myself now?

Before you leave the office it is important to discuss your standing before the next action step in your case. This includes dealing with your joint checking accounts and paying child support and/or alimony. If these details are not properly dealt with you can complicate the divorce process and possibly be charged exorbitant fees.

5.Do you allow me to negotiate directly with my spouse or do you prefer that all negotiations happen through each person’s law team?

6. How do I get a hold of you in an emergency? How long do you take to return phone calls? What do you consider an emergency?

7. What can you do to help me understand the tax effect of the decisions I have to make during this entire process?

Once you have asked your questions and followed through with a consultation you will be in a better position to make an informed choice on your case. Your lawyer is paid to help you during this trying time, and if your lawyer fits the bill of approval then you will be in good hands.
